These Terms and Conditions ("Terms") apply to your use of radlightingwa.com (the "Website") and to the permanent and holiday exterior lighting services offered by Rad Lighting WA ("Rad Lighting WA," "we," "us," or "our"). By using the Website or requesting our services, you agree to these Terms. If you do not agree, please do not use the Website.
1. Use of the Website
You may use the Website for lawful, personal, and informational purposes, such as learning about our services and contacting us. You agree not to misuse the Website, including by attempting to gain unauthorized access, interfering with its operation, submitting false information, or using it to send spam or harmful content. Any quote, estimate, or pricing we provide, whether through the Website, by email, by phone, or in person, is an estimate only and is not binding until both you and Rad Lighting WA sign a written agreement. Quotes may change if the scope of work, site conditions, measurements, or product selections differ from what was originally discussed. Unless stated otherwise in writing, quotes are valid for a limited time.
4. Scheduling and Site Access
Installation dates are scheduled by mutual agreement and may be adjusted due to weather, safety conditions, product availability, or other circumstances outside our control. We will make reasonable efforts to notify you of any changes. You agree to provide safe and reasonable access to the areas of your property where work will be performed on the scheduled date, and to let us know in advance of any conditions that may affect the work.
5. Payment and Deposits
Payment terms, including any deposit, progress payments, and the final balance, are set out in your written agreement or invoice. Please refer to those documents for amounts and due dates. Deposits and payments are handled as described in your written agreement or invoice. Late or missed payments may delay scheduling or completion of work.
6. Customer Responsibilities
Unless otherwise agreed in writing, you are responsible for:
- Providing safe access to your property and the installation areas, including securing pets and removing obstacles;
- Obtaining any required approvals from your homeowners association (HOA), landlord, or other parties before installation;
- Providing a working, accessible power outlet or other power source as discussed during your consultation;
- Informing us of any known hazards, hidden utilities, roof or structural issues, or other conditions that could affect the installation; and
- Providing accurate contact and property information.
7. Warranty
Installations may be covered by a written warranty that we provide with your installation. The terms, coverage, duration, and any exclusions of that warranty are set out solely in the written warranty documents provided to you. Nothing on the Website creates any additional warranty. Except as stated in the written warranty, and to the extent permitted by law, the Website and its content are provided "as is" without warranties of any kind.
8. Limitation of Liability
To the fullest extent permitted by law, Rad Lighting WA will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Website or our services. Our total liability for any claim related to the Website will not exceed the amount you paid us, if any, for the specific service giving rise to the claim. Liability related to installation work is governed by your written agreement and warranty. Some jurisdictions do not allow certain limitations, so some of these limitations may not apply to you.
